Appealing Deportation Orders

When a deportation (removal) order is issued, the clock starts ticking. Under Law No. 6458, you have only 7 days to file an appeal in the Administrative Court.

• Stay of Execution: In most cases, filing a lawsuit automatically stays the deportation process until the court reaches a final decision.

• Fast Resolution: The court typically concludes these cases within 15 days, providing a swift legal remedy against unlawful removal.

Administrative Detention Decisions

If a foreign national is held in a Removal Center (GGM), they are under administrative detention. We specialize in challenging these decisions:

• Objection to Detention: We apply to the Criminal Judgeships of Peace for the immediate release of the individual.

• Alternative Obligations: Where possible, we negotiate for alternative measures (such as reporting to a local station) instead of physical detention.

Invitation to Leave Process

In certain cases, the authorities may grant an "Invitation to Leave" (Terke Davet) instead of immediate deportation.

• The Window: You are granted 15 to 30 days to leave Turkey voluntarily.

• Entry Ban Protection: If you leave within this period and pay any outstanding fines, you may not be subject to a future entry ban, preserving your right to return legally.

4. Your Rights (The Shield of Article 55)

The law provides absolute protection for certain individuals. You cannot be deported if:

• You face a real risk of torture or inhuman treatment in your home country.

• Travel is life-threatening due to serious health issues, age, or pregnancy.

• You are receiving treatment for a life-threatening condition that cannot be treated in the destination country.

• You are a victim of human trafficking and are currently in the support process.

5. Fees & Costs

• Travel Expenses: By law, deportation costs are covered by the individual. If the state covers it, an entry ban remains until the debt is repaid.
